NON-IMMIGRANT VISAS


A “non-immigrant” visa is a temporary visa, which allows the holder to apply to enter the U.S. for a specific purpose and for a limited time.


Foreign nationals (FNs) may legally enter the U.S. as non-immigrants with a temporary visa.
Often non-immigrant entry into the U.S. is a two-step process:

  • First, the FN must obtain a visa stamp abroad at an American consulate

  • Second, the FN must present the visa stamp to the CBP Inspector at the port of entry to receive an I-94 card, which governs the length of stay.

Characteristics of non-immigrant visas


Specific purpose:

  • Each applicant must show he/she qualifies under one category

  • Performing an activity not permitted by the visa status and overstaying are offenses that may result in removal from the U.S.;

Limited duration:

  • The period of authorized stay in the U.S. is limited to accomplish the purpose;

Likelihood that alien will depart on completion of the purpose:

  • Usually it means a requirement of demonstrating ties to the home country;

  • Certain non-immigrant visas require the person to continue to maintain a residence in his/her home country;
